Terms of Service

1. Acceptance of Terms

By accessing or using the 4EverHonor website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. We may modify these Terms at any time, and such modification shall be effective upon posting. You agree to be bound to any changes to these terms when you use the Service after any such modification is posted.

2. Description of Service

4EverHonor provides a platform for users to create memorial pages for loved ones, share tributes, and facilitate donations to charitable organizations or personal fundraisers. The Service is provided "as is" and we are not responsible for any failure to store or transmit user content or communications.

3. User Conduct and Content

You are solely responsible for all information, data, text, photographs, graphics, messages, or other materials ("User Content") that you upload, post, publish, or display. You agree not to use the Service to:

  • Upload any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Upload any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
  • Violate any applicable local, state, national, or international law.

We reserve the right, but have no obligation, to monitor and remove User Content that we determine in our sole discretion violates these Terms.

4. Donations and Fundraisers

When you make a donation through the Service, it is your responsibility to understand how your money will be used. 4EverHonor facilitates the collection of donations for both 501(c)(3) charitable organizations and personal fundraisers.

  • To Charities: We will transmit your donation to the selected charity, minus any processing fees. Donations to registered charities are generally tax-deductible in the United States, but you should consult with a tax professional.
  • To Personal Fundraisers: Donations to personal fundraisers are considered personal gifts and are not tax-deductible. We do not guarantee that the funds will be used as described by the fundraiser organizer. We are not responsible for any disputes between users.

All donations are final and non-refundable.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of 4EverHonor and its licensors. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.

6. Disclaimers and Limitation of Liability

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL 4EVERHONOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
